Terms of Service

1. Who These Terms Apply To

These Terms of Service ("Terms") govern your use of the FieldProof platform provided by YPA-Group Inc. ("Company," "we," "us"), including the mobile application (iOS and Android), the web-based admin dashboard, and parent-facing tracking and notification features (collectively, the "Service").

The mobile app is not intended for use by children, students, or the general public. Accounts are created and managed by the employing organization.

2. Purpose of the Service

The Service provides a mobile workflow and operations platform that replaces manual paper checklists and handwritten forms with structured digital records for school bus transportation operations.

The Service is not a navigation guarantee, emergency dispatch system, or safety guarantee. GPS navigation is provided as a guidance tool; drivers are responsible for following all traffic laws, road conditions, and employer policies regardless of navigation instructions.

3. User Responsibilities

By using the Service, you agree to:

The Service does not replace required training, physical vehicle inspections, supervisory oversight, or professional judgment.

4. Accounts & Access

Operator administrators are responsible for managing user accounts, assigning roles, and maintaining accurate route and roster information within their organization.

5. Location Data & GPS Navigation

The Service collects real-time GPS location data during active routes to provide turn-by-turn navigation, live bus tracking, and route compliance verification. By using the Service during an active route, you consent to this location data collection.

Location data is collected only while the app is open and actively being used. We do not track users in the background or when the app is closed.

GPS navigation is provided as a convenience and guidance tool. The Company does not guarantee the accuracy, completeness, or timeliness of navigation data. Drivers must exercise independent judgment and comply with all applicable traffic laws, road signs, and conditions.

6. Notifications

The Service may send reminders or alerts related to incomplete workflows, required confirmations, bus arrival ETAs, and ride confirmation requests. These notifications are operational tools only and do not replace supervisory oversight.

Parent notifications (SMS and web tracking) are sent based on operator configuration. Parents may opt out of SMS notifications by replying STOP to any message.

7. Data Accuracy & Records

Records reflect user-submitted confirmations, system-generated timestamps, and GPS data.

Your employer is responsible for reviewing and relying on records for compliance purposes.

The Company does not guarantee that use of the Service prevents incidents, violations, or errors.

8. Data Ownership

Operational data generated through the Service (including inspection records, route logs, compliance reports, and student roster information) belongs to the subscribing organization (the operator). The Company processes and stores this data on behalf of the operator to provide the Service.

Upon termination of a subscription, operators may request export of their operational data. Data will be retained for a reasonable transition period, after which it may be deleted in accordance with our data retention practices.

9. Student Data

The Service processes student roster information (names, pickup and drop-off addresses, route assignments, boarding status, parent contacts) solely for transportation operations. This data is provided by operators or school districts (the Data Controller), not collected from students. The Company acts solely as a Data Processor for student data.

Student addresses are used to configure route stops and provide GPS navigation to drivers. This data is stored securely and accessible only to authorized personnel and route-assigned drivers.

The Company does not sell, monetize, or use student data for any purpose other than providing transportation-related services. Operators and school districts are responsible for ensuring their collection and sharing of student data complies with applicable laws, including FERPA, COPPA, and applicable state law, and that all necessary parental and regulatory consents have been obtained.

Access to student contact information within the platform is restricted to authorized personnel and route-assigned drivers only.

10. SOS & Emergency Features

If enabled, the Service may include an SOS or issue-reporting feature. This feature:

Any 911 shortcut initiates a call from the user's device only. The Company does not route or dispatch emergency calls.

11. No Warranties

The Service is provided "as is" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy of GPS data, or uninterrupted availability.

To the maximum extent permitted by law, the Company is not liable for:

13. Subscription & Payment

The Service is provided to operators on a subscription basis. Pricing, billing, and payment terms are established in the agreement between the Company and the subscribing operator. Individual drivers, aides, and other end users are not directly billed by the Company.

14. Termination

We may suspend or terminate access to the Service if these Terms are violated or if an operator's subscription is terminated. Operators may terminate their subscription in accordance with their service agreement.

15. Changes to These Terms

We may update these Terms periodically. Changes will be posted on this page with a revised effective date. Continued use of the Service after changes are posted constitutes acceptance.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
